These Terms of Service govern the use of the Wumbo site and platform.
These terms of service (“Terms”) cover your use and access to the services, client software and websites ("Services") of Wumbo.ai. By using our Services, you’re agreeing to be bound by these Terms and our Privacy Policy.
Wumbo (also "we", "us", "Service") Wumbo.ai is an AI-powered content creation platform.
Intellectual Property Rights and Permissions
All materials on this website, including text, graphics, and images (the "Content"), are the property of Wumbo or its representatives and are protected by copyright and intellectual property laws. You may not copy, republish, distribute, display, or commercially use any of the Content without prior written consent from Wumbo. Unauthorized use is strictly forbidden and may lead to legal consequences.
1. Agreement and General Terms of Use
1.1 You agree to abide by all of the provisions in this Agreement in order to remain an authorized user of the Services, and your use of the Services constitutes your agreement to abide by these provisions. Your use of the Service indicates that you are bound by this agreement with us. If you do not agree with any of these terms and conditions, discontinue use of the Service.
Unless you have been specifically permitted to do so, you agree that you will not reproduce, duplicate, copy, sell, trade or resell the Services for any purpose. This includes all website content, blog posts, YouTube videos, or any such property owned by Wumbo.
You agree and understand that you are responsible for maintaining the confidentiality of usernames and passwords associated with your account you use to access the Services. Accordingly, you agree that you will be solely responsible to us for all activities that occur under your account. If you become aware of any unauthorized use of your password or of your account, you agree to notify us immediately.
You understand that by using the Services you may be exposed to content that may contain errors or omissions and that, in this respect, you use the Services at your own risk.
1.2 Links to other Internet sites (hypertext links) are included as a convenience to you. When you access a linked site, you are accessing an independent site over which we have no control. The presence of hypertext links on our website does not mean that we endorse or accept any responsibility for the content or presentation of linked sites.
1.3 Nothing in these Terms gives you a right to use any of our trade names, trademarks, service marks, logos, domain names, and other distinctive brand features. You agree that in using the Services, you will not use any trade mark, service mark, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.
1.4 Account Sharing: You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password. You agree not to disclose your password to any third party or allow others to access your account. Sharing your account information or allowing unauthorized access is strictly prohibited and will result in the suspension or termination of your account, at our sole discretion.
We reserve the right to monitor for and detect unauthorized account sharing or activity, and you agree to indemnify and hold us harmless from any loss or damage resulting from unauthorized use of your account. If you believe your account has been compromised, please notify us immediately.
2. Registration, Refunds, Cancellation, Fees and Payments
2.1 As part of the registration process, you will be required to select a username and password. You will be responsible for the confidentiality and use of your username and password and agree not to distribute, transfer or resell you use of or access to the Service to any third-party. This means you are not allowed to share your access details with anyone. Doing so WILL result in suspension of your account and no refunds will be issued for such violations. We track all access details.
2.2 When you become a paid member ("subscriber, member") of any of the Services, you will be bound by the payment terms set forth herein.
2.3 Except as set forth herein or as described by offers we make from time to time, access to the entire Service requires payment. Rates vary. If you subscribe, you must provide accurate, complete and updated subscriber information. You acknowledge that you will pay Wumbo all such fees, charges, and applicable taxes for the Services where enrollment in the Services has been made using your credit card or other means, whether made by you personally or by someone else in your household or organization on your behalf.
2.4 You further acknowledge that your obligation to pay Wumbo all such fees, charges, and applicable taxes for the Service does not depend on usage of the Service, and that you remain obligated to pay Wumbo for the Service regardless of whether the Service is used or not. Unless you enroll as part of a free trial, your obligation to pay for the Service begins on the date of your enrollment in the Service, not the date of your first use of the Service. If made available, free trial or free access periods to use the Service also begin on the date of your enrollment in the free trial for the Service, and not the date of your first use of it.
The price you pay for a Service is stipulated at the time you enroll in such Service and is valid for the initial period for which you enrolled in the Service. Wumbo reserves the right to change the price paid for a subscription after the initial enrollment period. Of course, users will be notified if such price increase would ever occur.
2.5 Trail Offers & Refund Policy: We offer a 7-day trial of our service for a nominal fee. This gives you a chance to see if Wumbo is a fit for you. Please note that we do not provide refunds or prorated refunds for this trial or any occurring membership fees. Refund policies may vary depending on the specific service or offer, and some may not include refunds or may require an additional fee. Before signing up, please review the terms associated with your selected offer, as enrollment constitutes acceptance of those terms. If you have questions regarding cancellation rights, please contact our member support team.
Please note that trails are only available to first-time subscribers of Wumbo.
YOU ARE NOT ALLOWED MULTIPLE TRAILS. If you subscribe to a Service that allows for refunds, and cancel (and receive a refund) and then subscribe again, you will not receive a refund.
From time to time, Wumbo may offer its premium services through third-party vendors. In such cases, the vendor's refund policy would apply and may differ from your Service (or specific offer).
7 Day Trial: This offer (the "7-Days Trial"), which is made to you by Wumbo, entitles you access to the Wumbo Service for a period of seven (7) days from the moment that you activate membership by submitting your payment details (the "Trial Period"). By submitting your payment details, you accept the 7-Days Trial Offer and (i) consent to us using your payment details in accordance with our Privacy Policy, (ii) acknowledge and agree to Wumbo Terms and Conditions and these Wumbo Service Trial Terms and Conditions. If you decide that you do not want to continue as a paying user of the Wumbo you have to terminate your Service before the end of the Trial Period. You are limited to one use of this Trial Offer. Wumbo reserves the right, at its sole discretion, to modify or cancel this Trial Offer or the Wumbo 7-Day Trial Terms and Conditions at any time, without prior notice or liability.
2.6 You may cancel any subscription for the Service at any time during its term. However, Wumbo does not prorate any fees, charges , or applicable taxes associated with the Service upon any termination or cancellation and does not refund any such amounts for any term already charged. When you cancel, your subscription will still have access till your membership expire date.
Wumbo will reasonably attempt to return a cancellation confirmation to your email address on file. You should retain this confirmation as a record of your cancellation. If you DO NOT receive confirmation, it is possible something went wrong and we never received it. It is your responsibility to make sure we have received your request. You may contact us via email or the sites contact form. We are not responsible for requests that go unanswered as we likely never received them
2.7 Renewals: Your subscription will automatically renew at the end of each subscription term. You agree that we may automatically renew your subscription and charge your account on the anniversary of your last subscription date (the "Renewal Date"), unless you cancel your subscription before the Renewal Date. This means your subscription will automatically renew every month on your monthly enrollment anniversary or the last day of the month if you enrolled on the 29th, 30th or 31st and the current month has no such date. For annual subscriptions, this means every year on your annual enrollment anniversary. Your credit card or other form of payment will be automatically charged or debited unless you have cancelled your account. YOU MUST CANCEL PRIOR TO YOUR SUBSCRIPTION RENEWAL OR TRIAL END DATE TO AVOID CONTINUED CHARGES. However, there's never a renewal hassle with Wumbo. You can cancel this automatic renewal plan at any time during your membership. If your membership renews and you did not wish to continue, we will refund your renewal payment provided that you contact us within 15 days of the renewal date. After the end of the applicable 15 days, your subscription payment is non-refundable.
2.8 Multiple accounts are prohibited. We gather information from every user. If you have multiple accounts we will cancel your membership without warning and no refunds will be given. You may be banned from our site. Registering with new account or using multiple email addressed to avoid paying service fees is prohibited. If you have been a subscriber in the past you should use your existing account to renew. If you do not recall your login details, please contact our support or use the "forgot Password" link at our login page.
2.9 Termination of Services: We reserve the right to suspend or terminate your access to the Services if you're in breach of these Terms, if your use poses a risk to us or other users. In such cases, we’ll notify you via email and give you a chance to address the issue. However, if you're in material breach, or if notifying you would create legal risks for us, we may terminate your access without prior notice.
3. Wumbo Services are “AS IS”
We aim to offer you the best services, but there are certain aspects we cannot guarantee. To the fullest extent allowed by law, Wumbo and its affiliates, suppliers, employees, and distributors make no express or implied warranties regarding the services. All services are provided "as is." This includes disclaiming any warranties of service for a specific purpose, or non-infringement. Certain jurisdictions may not allow these disclaimers, so they may not apply to you.
3.1 Entire Agreement: These Terms constitute the complete and exclusive agreement between you and Wumbo regarding the subject matter addressed herein, and they supersede and replace any prior or contemporaneous agreements or terms related to the same. No other agreements, whether oral or written, will have any effect. Furthermore, these Terms do not establish any rights for third-party beneficiaries.
3.2 Virtual Private Networks: As the VPN market grows we understand that some of you may opt to use our services on a VPN network. It should be worth noting that we use your ip address as a login instance on our servers. If our system detects you logging in from too many ip addresses, it will lock your account down. This prevents sharing of access details and allows us to make sure your account does not get hacked. If you choose to use any VPN services, understand you may be locked out of your account because your ip address changes. We are not responsible for any time missed access to the site while locked out of your account. You may email our support team if you have any issues. Using a VPN may impact the performance of Wumbo, and we do not offer support for any issues that arise while using our services through a VPN.
3.3 Class Actions: Our lawyers said we needed to include this section. Wumbo will make every attempt to resolve any issues that may arise to your favor. By using our services you agree that Wumbo and its owners are immune to any class action suits. You may only resolve disputes with us individually and cannot file a claim as part of a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and combining other arbitrations are not allowed.
4. Disclaimer of Warranties & Limitation of Liability
4.1 YOU EXPRESSLY AGREE THAT USE OF THE SERVICE IS AT YOUR SOLE RISK. NEITHER Wumbo NOR ANY OF ITS PARENTS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, DISTRIBUTORS, THIRD-PARTY CONTENT PROVIDERS, OR LICENSORS (AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS) WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE OR THAT THEY WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE, OR AS TO THE ACCURACY, RELIABILITY, COMPLETENESS, OR CONTENTS OF ANY CONTENT, INFORMATION, MATERIAL, POSTINGS, OR POSTING RESPONSES FOUND ON THE SERVICE, ANY MERCHANDISE OR SERVICES PROVIDED THROUGH THE SERVICES, OR ANY LINKS TO OTHER SITES OR SERVICES MADE AVAILABLE ON THE SERVICES.
4.2 THE SERVICES, ALL TOOLS, CONTENT, MATERIAL, INFORMATION, POSTINGS, OR POSTING RESPONSES FOUND ON THE SERVICE ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
4.3 UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE OR GROSS OR WILLFUL NEGLIGENCE, SHALL Wumbo (OR ANY OF ITS PARENTS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, DISTRIBUTORS, THIRD-PARTY CONTENT PROVIDERS, OR LICENSORS (AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS), BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, ANY CONTENT, INFORMATION, MATERIAL, POSTINGS, OR POSTING RESPONSES ON THE SERVICE, OR THE SERVICE ITSELF. THESE LIMITATIONS APPLY REGARDLESS OF WHETHER THE PARTY LIABLE OR ALLEGEDLY LIABLE WAS ADVISED, HAD OTHER REASON TO KNOW, OR IN FACT KNEW OF THE POSSIBILITY OF SUCH DAMAGES. YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT Wumbo (AND ANY OF ITS PARENTS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, DISTRIBUTORS, THIRD-PARTY CONTENT PROVIDERS, OR (AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS), IS NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER, INCLUDING YOU. IN NO EVENT SHALL THE TOTAL LIABILITY OF Wumbo (OR ANY OF ITS PARENTS, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, DISTRIBUTORS, THIRD-PARTY CONTENT PROVIDERS, OR LICENSORS (AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS)) TO YOU EXCEED THE AMOUNT PAID BY YOU TO Wumbo DURING THE TWELVE (12) MONTHS PRIOR TO ANY CLAIM OF INJURY OR DAMAGE.
4.4 Intellectual Property: All of the Content on our websites and any Service we provide is protected by U.S. and international copyright laws and is the property of Wumbo and/or providers of the content under license. By "Content" we mean any information, mode of expression, or other materials and services found on Wumbo.
Any copying, distribution, storing, or transmission of any kind, or any commercial use of our Content, is prohibited without Wumbo's prior written permission. That means you may not sell, auction, transfer or barter your subscription or any individual publication.
You also may not republish, post, transmit, or distribute the Content to online bulletin and message boards, blogs, chat rooms, intranets, or anywhere else without our consent. You further agree not to create abstracts from or scrape our Content for use on another website or service (including our own personal forums and blogs). In short, you may not post our Content anywhere else online. Aside from opening yourself up to liability, distributing our premium Services, stock picks, and performance data to other sites and forums is unfair to our members who pay good money to receive our Content. So please don't do it.
Please note that notwithstanding the foregoing, when you post content (such as a message-board post or Blog), you are not somehow surrendering your copyright in your expression, but you are granting us an unlimited license to use it. Specifically, by posting content, you agree that Wumbo has an irrevocable, perpetual, and worldwide license to use republish, distribute, reproduce, display, communicate to the public, adapt, perform, store, translate, sublicense, and promote anything you post on our websites. This includes the rights to syndicate and make derivative works out of your content. If you don't want us to use or republish your content, then please don't post it on our websites. We'll only republish your content in context, and we'll credit you as author (unless we're using small quotations). We won't republish your posts in advertising without your permission. And we promise not to mock you unless it would amuse us.
You agree not to display any of Wumbo's trademarks or use them in any manner without our express written permission.
Abusive Use of Site: Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. You may not EMAIL OR upload to, distribute, or otherwise publish through the site any language which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable. Doing so will be grounds for automatic banning from site. Any fees paid will not be refunded and membership will be terminated.
